Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Stumbl ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Stumbl is a mobile application that helps users discover nearby bars, restaurants, and entertainment venues through a randomized selection ("roulette") feature. The App also provides features for group decision-making ("Party Mode"), venue check-ins, and reviews.

3. Eligibility

You must be at least 13 years of age to use this App. Certain features, including the Bars & Drinks category, require you to be at least 21 years of age. By enabling the 21+ toggle, you represent and warrant that you are 21 years of age or older. You must have the legal capacity to enter into these Terms.

4. User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Not use the App while operating a vehicle or in any situation where distraction could cause harm
  • Drink responsibly and never drive under the influence of alcohol
  • Provide accurate information when using app features
  • Not attempt to interfere with or disrupt the App's functionality
  • Not use the App to harass, abuse, or harm others

5. Venue Information

Venue information displayed in the App is provided by third-party services (Google Places API) and venue operators. We do not guarantee the accuracy, completeness, or timeliness of this information, including:

  • Operating hours
  • Prices and price levels
  • Ratings and reviews
  • Address and contact information
  • Menu items and availability

Always verify venue details directly before visiting.

6. Party Mode

Party Mode allows multiple users to participate in group venue selection. By creating or joining a party, you agree that:

  • You will share your party code only with people you intend to invite
  • Party activity is visible to all party members
  • Parties expire after 24 hours of inactivity
  • We are not responsible for actions taken by party members

7. User Content

You may submit reviews and ratings through the App. By submitting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute your content within the App. You are solely responsible for content you submit and represent that:

  • Your content is accurate and honest
  • Your content does not violate any laws
  • Your content does not infringe on third-party rights

8. Third-Party Services

The App integrates with third-party services including:

  • Google Places: For venue search and information
  • Firebase: For authentication and data storage
  • Uber/Lyft: For ride-sharing links
  • Apple/Google Maps: For navigation

Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services' availability or accuracy.

9. Intellectual Property

The App, including its design, features, and content (excluding user content and third-party data), is owned by Ishan Perera and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISHAN PERERA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. THIS INCLUDES DAMAGES ARISING FROM:

  • Reliance on venue information
  • Decisions made using the App
  • Interactions with venues or other users
  • App unavailability or errors

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY).

12. Alcohol Responsibility

Stumbl facilitates discovery of venues that may serve alcohol. By using this App, you acknowledge that:

  • You are solely responsible for your alcohol consumption
  • You will comply with all applicable laws regarding alcohol purchase and consumption
  • You will never drive under the influence of alcohol
  • We are not responsible for any consequences of alcohol consumption

13. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

14. Changes to Terms

We may modify these Terms at any time. Changes will be effective when posted. Your continued use of the App after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
